Terms of Service
The rules for buying and using 41aero products. They cover your account, payments, your licence, refunds and what you can and can't do with the software.
Agreement
These terms are an agreement between you and [TODO: legal entity name and registered address] ("41aero", "we", "us"). They cover the 41aero website, your account and dashboard, our flight simulator add-ons (including 41aero Ground) and support. By creating an account, buying a product or using one, you agree to these terms and to our Privacy Policy. If you don't agree, don't use them.
Your account
- You need an account to buy and use our products. Give us accurate details and keep your email address up to date, because that's where sign-in codes and receipts go.
- New accounts may need to be approved before they can buy. We can turn a request down without giving a reason.
- You must be old enough to make a binding purchase where you live, or have a parent or guardian's permission.
- Accounts are personal. Don't share your account or sign-in codes with anyone.
- You're responsible for what happens through your account. If you think someone else has access, tell us straight away at support@41aero.com. Staff will never ask for your password or sign-in codes.
Buying a product
- Prices are shown on the product page in US dollars, and you pay once. There's no subscription.
- Payments are handled by [TODO: payment provider]. We don't see or store your full card details.
- Your licence is added to your library as soon as the payment is confirmed. If it doesn't appear within an hour, open a support ticket.
- Prices may change, but a change never affects something you've already bought.
Refunds
If a product doesn't work on a PC that meets its listed requirements, and we can't fix it, we'll refund you. Ask through a support ticket within [TODO: number] days of buying. Where the law where you live gives you further rights to a refund or to cancel, these terms don't take them away. [TODO: confirm refund policy]
Your licence
When you buy a product, we give you a personal, non-transferable licence to install and use it for your own, non-commercial flight simulation, for as long as we offer the product, which we intend to be for life. You don't own the software itself.
- A licence covers one PC at a time. If you replace your PC or its main hardware, open a support ticket and we'll move the licence for you.
- Updates to a product you own are included. New products and separate add-on packs may be sold separately.
- Licences can't be resold, given away or moved to another account.
What you must not do
You must not:
- share your account or licence, or let someone else use your copy
- copy, resell, redistribute or upload our software, models, textures or other files, in whole or in part
- reverse engineer, decompile or modify the software, or extract its models and textures, except where the law allows it regardless of these terms
- get around the licence check, or help anyone else do so
- use our products for commercial training, events or broadcasts without our written permission [TODO: confirm whether streaming and videos are allowed; most studios allow them]
- attack, overload or probe our servers or other people's accounts
- harass staff or other users, or upload anything illegal or harmful to support tickets
Your setups
The airports, routes and spots you create in 41aero Ground are yours. You can share your own setups with other people who own the product. [TODO: confirm sharing policy]
Suspension
If you break these terms, we can suspend your account or licence. We'll tell you why, unless the law or a security issue stops us. If you think we got it wrong, email support@41aero.com from the address on your account and a staff member will review it.
Microsoft Flight Simulator
Our products are add-ons for Microsoft Flight Simulator. 41aero isn't affiliated with or endorsed by Microsoft, Asobo Studio or any airport, airline or vehicle manufacturer. Product names and logos belong to their owners. Sim updates can sometimes break add-ons. When that happens we'll work on a fix, but we can't guarantee one by a particular date.
Availability and changes
We work to keep our website and downloads available, but we don't promise they'll always be online or error free. We may improve, change or retire features over time.
Disclaimers
Except as described in these terms, our products are provided "as is", without any other warranties, to the extent the law allows. This doesn't affect any rights you have as a consumer that can't be excluded.
Limitation of liability
To the extent the law allows, we aren't liable for indirect or consequential losses, or for lost data. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't legally be limited, such as for death or personal injury caused by negligence, or fraud.
Closing your account
You can ask us to close your account at any time from a support ticket or by emailing support@41aero.com. Closing your account ends your licences. What we keep afterwards, and for how long, is in the Privacy Policy.
Governing law
These terms are governed by the laws of [TODO: country or state]. Disputes go to the courts there, unless the law where you live gives you the right to bring them locally.
Changes to these terms
We may update these terms. We'll change the date at the top, and we'll tell you about significant changes by email or with a dashboard notice before they take effect. Changes never take away a licence you've already bought.
